The Court of Alicante has sentenced a man to a year and a half in prison who attacked another in a Dénia premises, without proven reason, causing him to lose vision in his left eye.
A court of the Second Section issued this sentence, lower than the one requested by the prosecution. It is specified, therefore, that the attack occurred on August 7, 2019 for unknown reasons and considers it proven that the accused, as the complainant defended, approached the victim without saying a word while they remained in a Dénia bar. He gave her multiple blows to the torso and face, shouting "I'm going to kill you."
According to the Prosecutor's Office, the victim suffered bruises on his shoulder, ribs and left eye, for which he asked the aggressor for an 8-year prison sentence for a crime of injury.
The victim required medical treatment for a rib crack and left eye contusion with retinal detachment, requiring almost 100 days of treatment in which he was unable to perform his usual occupations, losing his sight.
The sentence was agreed upon by both parties after the accused admitted the facts at the beginning of the trial. Financial compensation was agreed to the victim, who decided to withdraw from the procedure without claiming.
Therefore, the defendant is sentenced to 18 months in prison as responsible for a crime of injury, due to the mitigation of damage repair. A restraining order of 300 meters from the victim for a year and a half has also been imposed on him, as well as the obligation to bear the costs of the process.
However, the sentence grants him the suspension of the execution of the sentence for a period of four years as long as he does not offend again.
