The TSJ rejects the appeal of the PP to the linguistic requirement of the Dénia City Council

The controversial use of the language requirement in the selection process for public employees in Dénia has finally come to nothing. This has been decided by the Superior Court of Justice by dismissing the appeal made by the PP in 2019.

During the Ordinary Plenary Session of the Dénia City Council in August 2019, the Valencian language requirement among the public workers of the consistory was approved by majority. A measure that did not sit well with part of the opposition. In fact, María Mut and José Antonio Cristobal, councilors of the PP municipal group, decided to bring the agreement to justice, but it was dismissed in April of last year by the Contentious-Administrative Court.

However, they decided to appeal the sentence, taking it to the TSJ. However, the High Court has again dismissed the appeal. In addition, they impose on the councilors the cost of the process.

For the councilor for human resources, Paco Roselló, "It is very clear that the government team's decision to guarantee that citizens can be properly served in Valencian at the Dénia City Council is totally legal."

For his part, the Councilor for Linguistic Normalization, Òscar Mengual, lamented that the PP continues to prosecute issues that "do not pose any problem for citizens and that are clearly legislated by supra-municipal institutions." Mengual has also shown his displeasure that «the Dénia PP uses the language of the Valencians and the Valencians to divide society when they have the obligation to promote and defend it, from mutual respect and the normality of use of the co-official languages ​​in the Valencian Community”.

Of course, the sentence is not final, since they could still raise the appeal to the Supreme Court if they present it in the next 30 days.

    The fight of tongues will lead us to conflicts where we will all lose.
    That public employees speak Valencian is very good, but that they only speak Valencian to citizens is something out of common sense, that is not giving a public service. That has happened to us several times in the cultural activities of the City Council.
    I undertake to collect signatures from Spaniards and foreigners so that the City Council recommends its employees and contracts so that no administrator is discriminated against for not speaking Valencian. We want to do away with the phrase “I am not a translator”.

    I strongly agree with the right of citizens to be served in their language.
    That there is preference in the hiring of people who, in addition to French and English, speak Valencian, is more than logical. But in Denia with Valencian and Spanish is not enough.
    All the citizens of Denia know how to speak Spanish, but not the other way around.
    One thing is what the laws say and another is kindness and common sense.
    I do not agree that public employees address foreigners in Valencian in an arrogant and unkind way. Nor to those of the rest of Spain. But when choosing new employees to serve the public, it is logical that people who, in addition to French and English, speak Valencian are preferably hired.
    The plugs and stuff has happened throughout history, but it's another issue that I think with the new rules for getting a public job, it's not going to happen so clearly.
